Visiting the website, submitting an order request, or placing an order constitutes full acceptance of all the above policies.

1. Definitions

1.1 Order Request
An order request represents your intent to purchase items and is considered a “future” at the stage of verification. All order requests are subject to approval or decline by Ukimart staff.

1.2 Order
An order is an order request that has been approved by Ukimart staff and for which the customer has agreed to the price quote. By making an order, the customer (you) confirms full acceptance of these Terms & Conditions and all aligned policies listed above.

1.3 Price Quote
A price quote is provided to a customer after their order request is approved. Price quotes guarantee exact pricing only if the item data you provide is completely accurate. If inaccuracies are found (e.g., incorrect item dimensions or weights), Ukimart will contact you to discuss solutions. By submitting an order request or accepting a price quote, you agree to pay any additional charges resulting from incorrect item information provided by you or a third party responsible for delivering items to our agent in Ukraine.

2. Compliance with Website Policies

By using Ukimart’s website, you agree to comply with all policies listed above. Clicking, submitting an order request, or completing an order constitutes agreement to:

3. External Links and Redirects

All buttons, links, and redirects on the Ukimart website may lead to external websites. Ukimart is not responsible for the content, accuracy, or practices of external websites, while making reasonable efforts to monitor and credit sources linked from our website.

4. Payment Processing

All payments on Ukimart are processed through Stripe. By completing a payment, you agree to Stripe’s policies and terms of use, including their privacy and dispute resolution terms.

5. Price Quotes, Accuracy, and Additional Payments

5.1 Price Quotes
You receive a price quote after your order request is approved. Price quotes are guaranteed only if the item information you provide is accurate.

5.2 Customer Responsibility for Item Accuracy
By submitting an order and agreeing to these Terms & Conditions, the customer confirms that if items arriving at the assigned agent in Ukraine are oversized or heavier than specified in the order request, the customer assumes full responsibility for these items, unless additional payment is made.

5.3 Additional Payments
Additional payments are calculated when our agent in Ukraine receives and measures items from your order and identifies discrepancies between actual dimensions/weight and those provided by the customer. Additional payments include:

  • The difference between the updated delivery cost for oversized items and the amount already paid by the customer.

  • Any additional AusPost delivery costs if final delivery is requested via AusPost.

  • A payment processing fee of AUD $0.30 + 1.75% of the total additional payment amount.

5.4 Minimum Additional Payment
If the overall additional payment (including transaction fees and AusPost fees, if applicable) is less than AUD $1.00, the additional payment is fixed at AUD $1.00.

5.5 Payment Deadline and Liability
The customer agrees to pay additional payments within 14 days of notification via the official Ukimart email (ukimart.au@gmail.com). Failure to pay within this period transfers full responsibility for the items to the customer, and Ukimart is released from any obligation to handle or deliver these items.

6. Website Usage, Security, and Prohibited Conduct

Unauthorized Access: Any attempts to hack Ukimart’s website, access databases, or use Wix APIs without written permission from Ukimart are strictly prohibited.

Legal Action: Violations may result in civil and criminal legal action under:

  • Crimes Act 1900 (NSW) – for unauthorized access to computers or databases

  • Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)) – for misleading information or contractual breaches

Coding or Manipulation Attempts: Attempts to use coding or scripts to gain access to Ukimart systems will trigger legal proceedings in NSW courts.

You agree that Ukimart may pursue full remedies available under Australian law for unauthorized access or breaches of these Terms & Conditions.

7. Delivery from Ukraine and War-Related Risk

7.1 Delivery Service Location
Ukimart provides a service to deliver items from Ukraine to the customer. By using this service, the customer acknowledges that the items will be handled and stored in Ukraine prior to shipment.

7.2 War and Conflict Disclaimer
Ukraine is currently experiencing armed conflict, including military aggression and occupation of certain territories. The customer acknowledges and agrees that:

  • The situation in Ukraine, including acts of war, military aggression, occupation, or other conflict-related events, is beyond the control of Ukimart.

  • Ukimart cannot guarantee the safety, condition, or timely delivery of items stored or transported in Ukraine under these circumstances.

  • Ukimart is not responsible or liable for any loss, damage, delay, or destruction of items resulting directly or indirectly from Russia’s military actions, aggression, occupation of storage sites, or other war-related events.

7.3 Customer Responsibility
By submitting an order and agreeing to these Terms & Conditions, the customer confirms awareness of the risks involved in delivery from Ukraine under the current war conditions and releases Ukimart from any liability or responsibility for loss or damage caused by such uncontrollable events.

8. Governing Law

These Terms & Conditions and any disputes arising from them are governed by the laws of New South Wales, Australia. You agree that Ukimart has the right to pursue legal action in NSW courts for any violations.

10. Confidentiality of Agents

10.1 Non-Disclosure Requirement
Customers must not disclose, share, or otherwise distribute any information relating to Ukimart agents, including but not limited to their names, contact details, or parcel delivery addresses.

10.2 Breach of Confidentiality
Any disclosure or misuse of agent information may result in immediate suspension or termination of the customer’s account, as well as potential legal action under applicable laws.

10.3 Agent Data Handling
All agent-related information is considered confidential and is processed in accordance with Ukimart’s Privacy Policy. Customers are prohibited from requesting, storing, or publishing any personal details of agents.

11. Lost Parcel Compensation (Nova Poshta and Other Carriers)

11.1 Carrier Responsibility
In the event that a shipment is lost or declared missing by Nova Poshta or any other delivery carrier, Ukimart will distribute the total compensation received from the carrier proportionally among all affected customers, based on the declared value of each lost order.

11.2 Limitation of Liability
Ukimart bears no further responsibility for compensation beyond the total amount reimbursed by the carrier. Customers acknowledge that this proportional distribution is final and binding.

12. Unpaid Goods and Transfer of Ownership

12.1 Payment Deadline
If additional payment for goods is not completed within 14 (fourteen) calendar days after notification is sent from Ukimart’s official email (ukimart.au@gmail.com), the customer forfeits all ownership rights to the goods acquired by Ukimart’s agent on their behalf.

12.2 Transfer of Ownership
After the 14-day period expires, ownership of the unpaid goods automatically transfers to Ukimart.

12.3 Disposal or Reuse
Ukimart reserves the right to dispose of, recycle, or resell such goods at its sole discretion without further notice or compensation to the customer.

13. Communication Consent

13.1 Contact Permission
By submitting an order or order request, the customer provides consent for Ukimart representatives to contact them via phone or email solely for matters directly related to their order, such as verification, payment, or delivery updates.

13.2 Marketing Communications
Ukimart will not use the customer’s contact details for unrelated marketing purposes or share them with third parties without explicit consent.

14. Agent Data Notice

14.1 Confidential Data Reminder
Customers are reminded that the names, contact information, and delivery addresses of Ukimart agents are confidential. This information must not be requested, stored, or shared by customers under any circumstances.

14.2 Communication Channel
All communication with agents must occur strictly through Ukimart’s official channels. Direct contact with agents outside of Ukimart’s system is prohibited.
